Cal. AG update – my talk with Gayle Weller

Ms. Weller called me back yesterday and here is a summary of the call.

1) The Cal. AG has been receiving complaints and FDRS issued refunds, but did NOT pay the debts.

They then sent a letter to FDRS and they refund the amount paid.  That’s because the people who submit the complaints don’t demand the FULL amount of all enrolled debts.

As I described in detail in previous posts, the money you paid to FDRS isn’t nearly enough to pay for your greatly INCREASED debts  (fees, interest, legal fees) and your credit rating is DESTROYED.

Hopefully you qualify for BANKRUPTCY if FDRS doesn’t pay your debts.

2) The complaints the Cal. AG received SUCK!

Ms. Weller explained in detail that they will not act unless the consumers PROVE that they have been wronged.  They expect consumers to prove their case just as in court.  They are NOT acting on behalf of consumers and working to prevent fraud, but they act as JUDGES and you are expected to be capable of submitting a comprehensive and fully documented complaint.

You have to include your contract, the FDRS advertisements and correspondence with FDRS for the AG to act on your complaint.

I told Ms. Weller that I have TRIED to help FDRS screwees who were simply not capable of sending me the documents I requested.  So many of the victims have serious medical problems and of course they’re all broke.

Do NOT send originals, always make copies.

3) The Cal. AG don’t seem to care about the FDRS unlicensed practice of law

I find that shocking.  Didn’t ANYONE submit the legal filings prepared for FDRS with their complaint?

4) Cal. AG doesn’t have the funds for investigations.

Ms. Weller stated that they receive about 2,500 complaints a month.   Big freaking deal?  Give me a break, a “small business” could EASILY handle those complaints with 20 employees.

The woman in charge of the Mohave county zoning violations has to deal with well over a hundred open cases BY HERSELF.  And she even has to personally inspect the properties.

Additionally, the state gets PAID for successful prosecutions.  I just posted AG Brown’s press release about CashCall and the state gets $1 million!   Of course they get NOTHING when they FAIL to act, FAIL to freeze accounts and allow the criminals to hide the assets.  Read my last post, about the FL AG recovery of funds from Hess Kennedy.

And if the morons in charge of California’s finances had half a brain and/or weren’t so corrupt, California would have a budget SURPLUS like North Dakota:

5) The Cal. AG don’t seem to think there’s anything wrong with FDRS stealing peoples’ money

That was the most shocking revelation.  That the people in charge of determining which companies to pursue don’t see that FDRS is a 200% fraud is simply inconceivable.  How can you look at the FDRS ads and literature and not realize that they are defrauding consumers?

Yes, I know, the complaints submitted by the victims suck.  But were they THAT bad?   I don’t have copies of the complaints and I don’t have the time and money to order them through freedom of information requests, but even if ALL complaints sucked, can’t somebody put two and two together?

6)  They are not allowed to access blogs.

Ms. Weller has never even been to this blog or to any of my sites with my research on FDRS. Can you imagine that an investigator is NOT allowed to research the web?

They’re so stupid, they don’t know the difference between porn and consumer complaints and reports of frauds and scams?  The investigators are going to spend their work day chatting with hot dates instead of working if they have web access?

I have received my share of inquiries from state investigators about scams, even from California, I think as recently as last year.  They read my blogs and asked for more info.

The investigators for the State of California Attorney General are not allowed to research the web.

Maybe it’s about time California falls into the ocean.  The mortgage crisis has been caused in large part by California’s refusal to investigate complaints about mortgage brokers.  Instead, a NOTORIOUS junk faxer of totally deceptive mortgage ads had been appointed to chairman of the CFHA by Schwarzenegger.

You’re dealing with MORONS at the California AG and you have to treat them like 10-year old kids, spell it all out for them.  And btw, Ms. Weller told me that she is NOT the person deciding which companies to pursue.  She did not disclose who those dimwits are.

I’m now properly motivated for my OPEN LETTER to AG Jerry Brown.

And, I will help my client who now has a Household judgment against him and just got served by Citi with HIS AG complaint.   It’ll be a PACKAGE since there are so many documents.

He will demand payment of ALL debts enrolled with FDRS.

7/09: Chase forgives the debts of account holders defrauded by Hess Kennedy debt elimination scam

Not only did Chase forgive those debts, but they also agreed to remove the accounts from the credit reports.

How did it happen?

Hess Kennedy was a Florida law firm operating under numerous names and scamming consumers with large unsecured debts just like FDRS.  The only difference: they actually had licensed lawyers involved, unlike FDRS, and they also promised to eventually settle the debts.

Hess Kennedy even set up bank accounts for “Capital One”, “Chase” and “Discover” so that the debtors could make payments to their creditors while in fact Hess Kennedy got the funds and nothing went to the creditors.

Chase and Capital One sued Hess Kennedy and the countless entities and criminals involved, obtained default judgments against several defendants and finally settled with Laura Hess & Associates, P.A., Hess Kennedy Chartered LLC, The Consumer Law Center, LLC, Hess Kennedy Company Chartered, Consumer Recovery Team, Hess Kennedy Holdings Ltd., Legal Debt Center, Hess Kennedy Company, Laura Hess, Inc., Hess Kennedy, Legal Debt Center, LLC, Hess Kennedy Florida, Hess Kennedy Chartered, Hess Kennedy, LLC, Hess Kennedy Payment, Hess Kennedy Trust Company, The Consumer Law Center, LC, Hess Kennedy Florida, Hess Kennedy Trust Account, Global Payment Processing, LLC, and The Campos Chartered Law Firm.

Last night I looked up the case and since then spent quite a few hours reviewing the documents.  Truly fascinating.

The Florida Attorney General sued Hess Kennedy and got a receiver appointed.

They discovered an extremely elaborate scheme involving many bank accounts and millions of dollars had already been moved out of the country.  Consumer credit counseling agencies were getting paid big bucks for sending the business.

I’m sure that Mark Cella, the FDRS owner and “Dan Lyle” also took action to protect their loot.  Last year someone posted that supposedly the California AG froze their accounts, but obviously that’s not true.

This morning I called Gayle Weller who is supposedly investigating to find out what’s going on, but I only got her VM and left a message to call me back.

Because the FL AG froze the accounts, Chase received $4.4 million!

Chase settled the case against Hess Kennedy et al last month for “Four Million and Four Hundred Thousand Dollars ($4,400,000.00) (“Settlement Payment”) via certified funds by hand delivery to counsel for Chase within one (1) business day of the Receivership Court’s entry of an Order approving this Agreement, substantially in the form of Exhibit B (the “Approval Order”).”  Not bad!

Additionally, Chase will receive 33% of any funds recovered in the suit by the receiver against The Credit Exchange.

My declaration in support of joining FDRS, Mark Cella, Herman Lewis and Kathy Quintos to creditor suit

Below is my Declaration in support of former FDRS clients’ motion for reconsideration and to add Federal Debt Relief System, Mark Cella, Kathy Quintos and Herman Lewis as responsible parties in the suit filed against them by Household.  The court had recently granted the Household motion for summary judgment.

The FDRS clients continued to pay FDRS and they expected competent legal representation as PROMISED in the FDRS literature.

Kathy Quintos with FDRS provided the court filings and her emails with the instructions on how to file as well the attached documents were filed as exhibits to the motion.

Of course the FDRS contract and the false FDRS promises of assignment to an attorney are also filed exhibits.

I attached my fax to attorney Hammerman (Household) and his response as exhibits to my declaration:

As you can see, Hammerman is not at all interested in pursuing FDRS.  Of course he WANTS to get those payments for legal fees after consumers with no legal skills whatsoever file these MORONIC FDRS motions.

I have NO clue what the judge is going to say.

I doubt he’s ever seen anything like this.  And he SHOULD take action to have the AZ AG pursue FDRS and the employees engaged in the unlicensed practice of law, I believe a felony in AZ.

Obviously, these motions to join FDRS and most important, the PEOPLE engaging in the unlicensed practice of law and the sale of this FRAUD, should be filed at the BEGINNING of a creditor suit.

And while it’s not necessary to ask the creditors for assistance, I think it adds a very nice touch and their refusals just give us one more reason to stop paying unsecured debts AFTER becoming judgment-proof.

So my next step is to submit the complaints regarding the unlicensed practice of law to the DA in California and to the Cal AG.   In my opinion, the state of California and the Federal Reserve should be paying these debts.

$50k demand to FDRS — request for assistance to creditor attorneys

FDRS didn’t respond to the demand letter requesting that they either assign attorneys to defend my client against creditors as promised or to eliminate the debts as it promised.  My client is now asking the creditors’ attorneys for assistance to get FDRS to deliver on its promises to eliminate the debts by PAYING the debts.

At the time of enrollment, the total debt was only about $35,000.  But due to interest, fees and legal expenses it increased to about $50,000.

FDRS and its Kathy Quintos provided the most outrageous documents for filing with the courts and arbitration and the creditors’ attorneys had to respond and racked up quite a few hours in attorney time.

Ms. Quintos can look forward to jail time — unauthorized practice of law is a serious issue in California.

FDRS received the demand letter, but its response was limited to noting the account as cancelled.  So we just contacted all the creditors or their attorneys (active litigation and arbitration) and I’ll update with their responses.  Hopefully they’ll sue FDRS,  Debt Crisis Solutions and all the other scammers out of business.

If the creditors don’t take action, my client will have to try to find an attorney to have FDRS added to the litigation as liable 3rd party.  

The $6,700 my client paid to FDRS would probably have been sufficient to SETTLE all debts.

Chase has offered other clients to settle for about 10% of the outstanding balance right after the accounts were charged off.

The complaint about the unlicensed practice of law as well as an open letter to the Cal. AG are next.   It’s incredible that they have done NOTHING!

… Brown has been leading the fight against fraudulent loan modification companies. He has sought court orders to shut down several companies including First Gov and Foreclosure Freedom and has brought criminal charges and obtained lengthy prison sentences for deceptive loan modification consultants.

They CAN take action if they want to.  The ongoing AG “investigation” of FDRS looks more like they are on the FDRS payroll than an investigation.

Sample letter to collector or creditor who sued

Of course debts enrolled in the FDRS or Debt Crisis Solutions or any of these scams should be disputed as such:

I have paid this account (am paying) to [FDRS, Debt Crisis Solutions, etc.]

If you’ve been sued, inform them of the TRUTH.  Ask for their help to recover the money from FDRS or Debt Crisis Solutions or whoever you paid.

Here’s a sample letter I drafted for someone with a Discover judgment against him and he also got sanctioned by the court for submitting the idiotic FDRS legal filings.

CHANGE this letter according to YOUR situation:

Re: [Creditor] v. [you] Judgment and Sanctions

Dear Ms. [attorney name]:

I received your [date] letter demanding the amount of $810 for sanctions.  I incurred my credit card debts due to [whatever the problem was] and I eventually could not keep up with my credit cards.

On [date] I enrolled in the [Federal Debt Relief System (FDRS) or whatever] program to eliminate my debts and I have been making monthly payments to [FDRS, whatever] for my credit cards including the [account you're sued for].

[As you know, FDRS gave me legal advice and it prepared my filings for me after you filed suit against me on behalf of Discover. As the attorney in this case, you are also fully aware that I lack any understanding of the legal procedures, rules and content of those filings.]

However, I do know that I have paid thousands of dollars to FDRS and they apparently deceived and defrauded me. I still suffer health problems and I do not have the funds to pay you.

I hope that you will NOT levy my bank account or [list whatever action they threatened with] as [describe your situation, why you can't afford to pay.]

I am now writing a letter to FDRS, demanding that it pay the entire amount due to [creditor] as well as the other enrolled accounts.

If FDRS doesn’t pay, will you please represent me and sue them to pay up?

Also, according to the FDRS account log, it sent numerous letters to [creditor] and to you during 2008 on my behalf, possibly under my name. I never received copies.

Please provide my with all communications received by you and [creditor] on my behalf or allegedly from me from [enrollment date] to present.

I also intend to file complaints with the California and [your state] AGs and the FTC and I want to provide as much documentation as possible to regulators.

I obviously need help with these legal matters and this is all very stressful for me.

I felt really sorry for the person who got so screwed by FDRS and I offered to help him free of charge.  But people only want ME to do all the work and somehow get $45,000 (in this case the approximate amount of enrolled debt, attorney fees, sanctions and interest/fees to date) with one letter to FDRS.

He didn’t like the Discover attorney and has “no need” for her.    Well, I have no need to work for free to help just ONE person AND the help of the CREDITORS critical. They have unlimited funds for attorneys.

FDRS would probably have paid the $45,000 real quick INSTEAD of being sued by Discover.

A big bank can crush an outfit like FDRS in no time and you may have seen the Cap One and Chase suits against similar outfits.

And if Discover had REFUSED to sue FDRS and it continued to pursue the consumer, it would look REALLY bad.

How can they MORALLY justify garnishing wages KNOWING what really happened?  Discover already got sued because one of their customers committed suicide due to their harassment and I don’t think ANY bank would like the publicity of collecting from a consumer, KNOWING that he paid another company and was defrauded.

This is the win win situation – peg the morons AGAINST each other.

I was going to wait until he got his check, but since he has “no need” to bring FDRS down or to save thousands of dollars and he decided to rather PAY the judgment to Discover, run with it.

It’s up to YOU to take action. 

Of course I know that FDRS is reading this, but why would I care?  They are about out of business anyway and I sure have better things to do than to work free of charge for people who don’t appreciate it.

Debt Crisis Solutions is a much bigger problem.

I’m NOT the only person who dedicated her life to helping others and to making the world a better place for all – only to eventually realize that most of you are EXACTLY like Mark Cella: you only know how to TAKE.

I always thought that there is power in solidarity and that WE can accomplish ANYTHING if we just stick together.

Obviously, I was wrong.

I’m amazed that people are so loaded with cash, they’ve already thrown thousands of dollars at FDRS and STILL have MORE CASH to throw at creditors.

Why aren’t they paying ME?

Sorry for the late approval of comments — didn’t get the notifications

I just found a number of unapproved comments and I have no idea why I didn’t receive the notifications, but apparently that’s a problem since my notebook died a few weeks ago.

Unfortunately, I also received several moronic comments including one identified as FDRS which I won’t approve.  What are they smoking? 

It is of course because of the morons that I can’t have comments approved automatically. 

I’m hoping that I get this email problem fixed whenever I’ll finally receive the drive kit I ordered OVER a week ago.  I’ll make an effort to manually check for comments here until then.
